The special conditions for each property are described in detail in the information specific to that property. Accepting these conditions implies agreement with the special conditions of the property being booked.
Fora-Vila Sa Pobla S.L. or, by its trading name, Foravila Rentals, registered at Carrer de Madò Buades 12, 07420 Sa Pobla, Illes Balears, with company tax identification number B57825994, is the intermediary agent between owner and lessee in property rental operations, referred to herein as Foravila Rentals.
The property owner or legal representative of the property, who has appointed Foravila Rentals to handle its rental operations, referred to herein as the Property.
The lessee is the client or user interested in renting the property, referred to herein as the User.
The subject of the present booking conditions is the regulation of the contractual relationship which has arisen between the Property and the User.
Foravila Rentals is not a contractual party to the rental of the property, either as lessor or lessee. Foravila Rentals acts in the name and on behalf of the Property and the User, for the seasonal letting of residential property, subject to Urban Lettings Act 29/1994, of 24 November, with particular and express reference to part 1, section 3.2; or as Tourist Holiday Stays subject to Decree 17/2006, of 17 February, which implements Act 2/2005 on the commercialisation of tourist accommodation in residential property duly approved for the purpose.
Payment will be accepted by bank transfer, credit card or debit card (Visa, MasterCard).
The User must pay an amount as a deposit. This amount will be specified at the time of booking and may vary depending on the selected check-in and check out dates, as well as the selected number of guests.
If the selected payment method is bank transfer, the User will have 48 hours to pay the amount indicated as a deposit. Foravila Rentals reserves the right to disregard the booking if the deposit is not paid within the stipulated period.
Confirmation of the booking will be issued once the aforementioned payment has been received.
If the amount paid as a deposit is less than 100% of the total reservation amount, the remaining amount will have to be paid following the deadlines indicated at the time of booking, which may vary depending on the selected check-in and check out dates, as well as the selected number of guests. Foravila Rentals may cancel the booking and apply the corresponding cancellation policies detailed in point 5 of these terms and conditions should the balance not be settled within the stipulated period.
Where payment is made by bank transfer, to facilitate the payment process the User must email a copy of the payment slips to Foravila Rentals, as well as bear the cost of any bank charges and commissions arising out of these transactions.
Prices are indicated in Euros (€) and include the relevant taxes, except where specified to the contrary.
The Property, or Foravila Rentals on its behalf, reserves the right to request a security deposit against damage, breakages, defects, theft or excessive soiling of the target property. Where a security deposit applies, details will appear in the section on security deposit in the specific property information.
The security deposit will be payable by bank transfer, credit card or debit card (Visa or MasterCard) and it will need to be paid on the check-in date the latest. The User will receive a payment reminder via email 7 days before the check-in date.
The security deposit will be refunded within 7 days of departure from the property, provided no damage has been caused to the accommodation.
In exceptional cases, payment of the security deposit may be accepted in cash. In these circumstances, the User must provide the number of a bank account into which the security deposit may be refunded within 7 days of departure.
Where no security deposit is payable, the Property, or Foravila Rentals on its behalf, may require the User to pay a sum in compensation equal to the cost of any damage, theft or excessive soiling. The User is liable for any damage to the property that may be inflicted by the User during their stay.
Length of stay may be modified by written application to Foravila Rentals, under the following circumstances and subject to the following conditions
The length of stay in the chosen property may be extended, provided the property is available for the proposed dates. No changes to the booking will be made until the new payment has been received. The amount to pay in order to confirm the extension will be calculated following the payment conditions determined at booking time.
A reduction of the length of stay must be notified as far in advance as possible. The total price of the booking will be adjusted following the payment and cancellation conditions determined at booking time. The possibility of a reduction of the length of stay will always depend on the minimum stay defined on the target property for the selected booking dates.
Modification in the number of guests will be allowed provided the property has sufficient capacity and reasonable notice is given.
In the event of cancellation on the part of the User, the conditions indicated at the time of booking, which may vary depending on the selected check-in and check out dates, as well as the selected number of guests, will apply.
The User will lose 100% of the total booking price in the event of a failure to arrive (no show).
Foravila Rentals may be able to give a refund or waive the cancellation penalties to the User if the User has to cancel because of an unexpected circumstance that's out of the User's control. Below is a list of circumstances covered by the Cancellation Policy. Before any cancellation is requested, the User may check that the given circumstances are included in the list below and that the required documentation can be provided.
It's important to keep in mind that penalty-free cancellations are only available for force majeure circumstances that occur before the User's reservation check-in date.
Death of the User, or additional guest, immediate family member, or caregiver. You'll be asked to provide one of these documents:
Unexpected serious illness or injury affecting the User or member of the travelling party. The User will be asked to provide a statement from a physician confirming that the person can't travel due to an unexpected, serious illness or injury. The statement must be also dated after the reservation was booked and provided within 14 days of cancellation. At this time, pre-existing conditions known to the user at the time of booking are not covered by the Cancellation Policy.
Government-mandated obligations including jury duty, travel restrictions, court appearances, and military deployment. The User will be asked to provide a copy of the official notice dated after the reservation was booked, including the name of the person fulfilling the obligation.
Transportation disruptions that make it impossible to travel to the destination, including road closures and flight cancellations where there are no alternative methods of travel. This includes closures and cancellations caused by natural disasters, such as earthquakes or severe storms. The User will be asked to provide a notice of the road closure, or documentation from the airline that the flight was cancelled and supporting documentation confirming that it's not possible to travel to the destination
Train, bus, or ferry cancellations where no alternate trips were available on the same day. The User will be asked to provide documentation that clearly shows the carrier was not operating on that day, such as a screenshot of the company's website or a link to an official statement from the carrier.
There's no required documentation for these circumstances, but our specialised team will review each case to confirm that you're directly affected.
Natural disasters, terrorist activity, and civil/political unrest that prevent the User from traveling to or from the destination, or that make it unsafe.
Epidemic disease or illness that suddenly affects a region or an entire group of people. This doesn’t include existing diseases that are associated with an area. Any updates to our policy regarding the outbreak of a disease, and the scope of policy application, will be determined based on announcements by the World Health Organisation and local authorities.
Travel restrictions imposed by a government, law enforcement agency, or military that restrict travel to or from the listing location.
Safety and security threat advisories issued for the property's location or the User party’s departure location.
Changes to visa or passport requirements that make it impossible to travel to the destination. This doesn’t include lost or expired travel documents..
The Property or Foravila Rentals may have to make changes to the User's booking in the event of situations of force majeure. If for this reason the property cannot be offered in optimum conditions, the User may opt to either accept another property or cancel the booking. Should the User choose the second option, Foravila Rentals will refund the amount paid to date.
Neither the Property nor Foravila Rentals assumes liability for any stolen goods or theft which may occur within the property during the User's stay..
The maximum occupancy of the property is indicated on the booking confirmation. Exceeding the permitted capacity without prior authorisation may give rise to the cancellation of the agreement without the right to a refund of the price paid. The property subject of the following contract is solely and exclusively for use as seasonal or tourist residential accommodation and may not be used for other purposes such as banquets, celebrations, parties, seminars, etc., without the knowledge and approval of the Property or Foravila Rentals. Engaging in any activity other than that of a seasonal or tourist stay, or exceeding the maximum capacity established for the property in number of beds, will lead to immediate termination of the rental under the terms described above.
Foravila Rentals will take all the precautions necessary to ensure that the properties are accurately described in all their publications. However, given that the properties are not under the company's direct, permanent control, Foravila Rentals undertakes to swiftly repair any deficiencies to the property or find a suitable alternative that meets the User's expectations.
Although generally speaking pets are not prohibited, the User must apply to Foravila Rentals to obtain the Property's confirmation and consent prior to confirmation of the booking.
The property will be handed over clean and provided with bedding and towels. The User will be responsible for keeping the house clean during their stay.
Where a property offers a cleaning, linen change and maintenance service, the persons in charge of cleaning, as well as garden, pool and general maintenance, reserve the right to hold a key to the property and to access the interior, even in the User's absence.
For stays of longer than seven days, the User will be provided with a change of bed linen and towels at no extra charge.
Arrivals must occur from 16:00h. The property must be vacated before 10:00h on the day of departure.
The parties agree to surrender any disagreements that may arise to the jurisdiction and competence of the courts and tribunals of Inca, Mallorca.
